The Commission has also published guidelines to help GPAI providers meet obligations kicking in 2 August 2025, and those guidelines are often used as a checklist for documentation, transparency, and downstream information sharing.

Operationally, audit-ready AI tends to mean: a live system inventory; risk classification with documented rationale; technical documentation that can be produced quickly; clear lines of responsibility; and repeatable testing and monitoring. Where organizations rely on third-party models, audit readiness also means having a defined evidence intake process, so vendor artifacts arrive in a usable, reviewable format.

Importantly, audit-ready does not only protect against AI Act exposure. It also reduces the chance that GDPR enforcement will derail AI products, because the same evidence, data maps, transfer assessments, transparency records, often forms the backbone of both AI governance and data protection compliance.

8) Simplification politics while fines loom: compliance investment meets lobbying

Enforcement pressure is also influencing policy debates. Reporting on Commission “simplification” discussions around GDPR in the context of AI competitiveness shows a tension: policymakers want to support innovation, while companies face escalating compliance costs and material penalty risk.

For businesses, this dynamic creates a two-track strategy. Track one is accelerated compliance investment, because the AI Act’s penalty tiers and phased enforcement dates are fixed points that cannot be negotiated away in the short term. Track two is advocacy: pushing for clearer guidance, reduced fragmentation, and workable interpretations, especially where AI development depends on large-scale data processing.

Even if simplification initiatives progress, they are unlikely to remove the core expectation that organizations can demonstrate control. In that sense, fines are reshaping AI compliance not only through punishment, but by making “proof of compliance” a standard competitive requirement for selling AI-enabled products in Europe.
